A trial team led by E. Leon Carter of Carter Arnett PLLC; Craig Stokley of Stokley PLLC; Jesse Jenike-Godshalk and Carrie Shufflebarger of Thompson Hine LLP, obtained a complete defense jury verdict on behalf of Russell Brands LLC’s Spalding brand against trademark infringement and unfair competition claims of over $1.1 billion. The Plaintiff, McKinney, Texas-based True Believers Ink 2, contended that Spalding used its trademark in a marketing campaign without its permission. Following the trial before Honorable Amos L. Mazzant III in the U.S. District Court for the Eastern District of Texas, Sherman Division, the jury found that the Plaintiff in fact never owned the primary mark in dispute, and that Russell Brands LLC never used any trademark owned by Plaintiff. Russell Brands LLC is a wholly-owned subsidiary of Fruit of the Loom, Inc.
