Representative Matters

  • Obtained a favorable outcome for its first lien lender client in a case where the prior owner of the property claimed a perpetual right to repurchase the property free and clear of subsequent liens.
  • Obtained a ruling on behalf of its client owning a drilling fluid manufacturing and recycling plant that its secured lender’s lien was limited to moveable personal property and did not extend to the real estate underlying the plant or any personal property that had become affixed to the real property in the construction of the plant.
  • Obtained a temporary injunction, and defended the injunction on appeal, on behalf of a real estate developer to prohibit a neighboring landowner from interfering with the project’s stormwater drainage system.
  • Obtained an eight-figure jury verdict against the seller of six apartment projects in a complex transaction utilizing multiple limited partnerships where the transaction partially closed and then failed. 
  • Obtained an eight-figure jury verdict on behalf of real estate investment trusts against a lender for breach of a $160 million lending commitment where the lender reneged after world economic conditions changed and refused to fund acquisitions of additional properties.
